Welcome to New Mexico Medical Marijuana Laws

On April 2, 2007 the Lynn and Erin Compassionate Use Act (Senate Bill 523) went into effect in the State of New Mexico.  The purpose of this act is to allow the beneficial use of medical cannabis in a regulated system for alleviating symptoms caused by debilitating medical conditions and their medical treatments. 

A practicing MD in New Mexico can recommend marijuana for patients to lessen the debilitating symptoms of a number of serious medical illnesses. Some of these qualifying diseases and conditions include severe nausea, HIV/AIDS, cancer, severe chronic pain, glaucoma, muscle spasticity and muscle spasms (often associated with multiple sclerosis), cachexia (wasting that results from several diseases), seizures (including those related to epilepsy).

Under this law a patient may apply for a license to use medical cannabis and can possess a supply of not more than 6 ounces at any one time.  Our Staff at New Mexico Green Light will help you navigate the many laws and regulations regarding medical cannabis.

Those people that wish to grow their own medical cannabis can do so by applying for a producer’s license.  A patient can also appoint a care-giver who has been approved by their signing physician. Our helpful staff at New Mexico Green Light is there to guide you through this complex process.

It is important to know that under this law a qualified patient (one possessing a New Mexico Medical Marijuana License), shall not be subject to arrest, prosecution, or penalty in any manner for the possession of or the medical use of cannabis if this quantity does not exceed 6 ounces.

This State Law protects the licensed patient and care-giver, however the production, possession, and use of medical cannabis is still illegal under federal law.  This is one of the reasons it is hard to find physicians to recommend patients.  A practicing physician must apply for a federal license to proscribe drugs and many fear that recommending medical marijuana would jeopardize their federal license.  Our physicians at New Mexico Green Light understand the laws and regulations regarding medical cannabis and will sign for patients who qualify.
